Court Rules in Favour of Dambazau's Son




After a controversial legal battle, yesterday the Kaduna Court of Appeal has ruled in favour of Honorable House Member Shamsudeen Dambazau, son of former minister of interior, affirming his position as the rightful Representative of Takai/Sumaila, Kano State.

This decision comes after a series of legal battles starting from the omission of his name by INEC before the commencement of the 9th Assembly. In an act to add salt to injury, the matter of the omission became the focus of an Election Petition Tribunal held in Kano against the Honourable, where he lost the petition and the Tribunal ordered INEC to issue a certificate of return to PDP’s candidate.

Despite the setback, Hon. Shamsudeen appealed against the ruling of the Tribunal at the Appeal Court Kaduna Division and won. The matter was further taken to the Supreme court where it was ruled, again, in his favour, and INEC was ordered to reinstate him as the representative of the Takai/Sumaila constituency.

However, Suraja Kanawa of the PDP, filed a petition against Shamsudeen alleging incompetence at the national and States Houses of Assembly Election Petition Tribunal in Kano. Today, the Court of Appeal, Kaduna Division not only upheld Shamsudeen’s appeal but it also struck down Suraja Kanawa’s petition in Kawu sumaila V. Suraja kanawa & ors, on the grounds that the tribunal's decision was null and void given that it had no legal jurisdiction to entertain the petition due to Hon Mohammed not being a party in the suit, which further affirms the victory of Hon. Mohammed Shamsudeen Danbazau by the Court.

It's obvious that the petition has been nothing but the adversary's attempt to derail the exercise of his duty in representing his constituents and we are glad that his legitimacy has come to light. Honorable remains in good spirits and is looking forward to resume his duties. We reached out Sadiq Samaila, his senior legislative aide, for comment who relayed his message, thus "Alhamdulillah, we thank ALLAH SWT for making us victorious and we are thankful to our supporters and our constituents for staying by our side throughout this battle. The court's victory today is not our victory, it's a victory of our great constituents, it's a victory of democracy, and it's a victory of justice. Our goal has always been and will always be discharging our duties in effectively representing our constituents to the best of our ability. We look forward to doing so with full capacity and full dedication and we appreciate and pray for your continued support"

This statement is a testament to Honorable's patience, courage, and good character. The decision today shows that truth will always prevail despite smears and mudslinging attempts to discredit his legitimacy. We applaud the courts swift and judicious decision in reaching its verdict and we also commend the good people of Takai/Sumaila for believing in him, exercising patience and supporting him during these trying times.
